Terms of service
This website is operated by Mobility Harbour, LLC. Throughout the site, the terms "we", "us" and "our" refer to Mobility Harbour, LLC. Mobility Harbour is an online-only retailer with no physical storefront, and offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink, including our Refund Policy and Shipping Policy. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, and contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
Any new features or tools which are added to the current store shall also be subject to these Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Section 1 – Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, or that you have given us your consent to allow a minor dependent to use this site on your behalf.
You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.
You must not transmit any worms, viruses, or any code of a destructive nature.
A breach or violation of any of these Terms will result in an immediate termination of your access to the Service.
Section 2 – General Conditions
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements. Credit card information is always encrypted during transfer.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
Section 3 – Accuracy, Completeness and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete, or current. Material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. This site may contain historical information that is not current and is provided for reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on the site.
Section 4 – Modifications to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service, or any part of it, without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
Section 5 – Products
Certain products may be available exclusively online and may have limited quantities. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. We have made every effort to display product colors and images as accurately as possible, but cannot guarantee that your device's display will be fully accurate.
We do not warrant that any product purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Section 6 – Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us, and may, in our sole discretion, limit or cancel quantities purchased per person, household, or order. In the event we change or cancel an order, we may attempt to notify you using the contact information provided at the time the order was made.
You agree to provide current, complete, and accurate purchase and account information for all purchases made on our store, and to promptly update that information as needed so we can complete your transactions and contact you.
Section 7 – Optional Tools
We may provide access to third-party tools that we neither monitor nor control. Any use of such tools is entirely at your own risk, and we have no liability arising from your use of them. You should review the terms of any relevant third-party provider before use.
Section 8 – Third-Party Links
Certain content and services on this site may include materials from, or links to, third parties that are not affiliated with us. We are not responsible for the content or accuracy of any third-party materials or websites, and we are not liable for any harm arising from your use of or transactions with any third party.
Section 9 – User Comments, Feedback and Other Submissions
If you send us comments, ideas, suggestions, or other materials, you agree that we may use them without restriction and without any obligation to compensate you or keep them confidential. We may, but are not obligated to, monitor, edit, or remove content we determine in our sole discretion to be unlawful, offensive, or otherwise objectionable. You are solely responsible for the accuracy and legality of any comments you submit.
Section 10 – Personal Information
Your submission of personal information through the store is governed by our Privacy Policy.
Section 11 – Errors, Inaccuracies and Omissions
Our site may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, and availability. We reserve the right to correct any such errors and to change or cancel orders if any information is inaccurate, at any time and without prior notice, including after an order has been submitted.
Section 12 – Prohibited Uses
In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate any applicable regulations or laws; (c) to infringe upon our intellectual property rights or those of others; (d) to harass, abuse, or discriminate against any person; (e) to submit false or misleading information; (f) to upload viruses or malicious code; (g) to collect or track the personal information of others; (h) to spam, phish, or scrape the site; or (i) to interfere with or circumvent the security features of the Service.
Section 13 – Disclaimer of Warranties; Limitation of Liability
We do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error-free. The Service and all products delivered through it are provided "as is" and "as available," without warranties of any kind, either express or implied, except as expressly stated by us.
In no case shall Mobility Harbour, LLC, our directors, officers, employees, affiliates, agents, or suppliers be liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or any product procured through it, even if advised of the possibility of such damages. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability in such states shall be limited to the maximum extent permitted by law.
Section 14 – Mobility and Medical Equipment: Safety and Proper Use
The products sold through this site – including power wheelchairs, power lift recliners, mobility scooters, and power mobility vehicles – are manufactured products subject to the manufacturer's own instructions, warnings, and use restrictions. Before operating any product purchased through this site, you are responsible for reading and following the applicable owner's manual and all manufacturer safety warnings, including stated weight capacity and intended use.
Do not exceed the rated weight capacity of any product. Do not use any product for a purpose other than its intended use, or in a manner inconsistent with the manufacturer's instructions. Improper use or misuse of mobility equipment can result in serious injury or death, and may void the manufacturer's warranty.
Vehicle-mounted lifts and similar equipment should be installed only by a qualified, trained professional; confirm compatibility with your specific vehicle and mobility device before purchase or installation.
Assembly & Setup Assistance is an optional service offered separately from the purchase price of eligible products. If you decline this service, you are responsible for unpacking, assembling, and setting up the product yourself, or arranging for someone to assist you, in accordance with the manufacturer's instructions. Charges for assembly, setup, and delivery services are governed by our Refund Policy.
Mobility Harbour is not the manufacturer of the products we sell. Where a product is covered by a manufacturer's warranty, that warranty – and its terms, exclusions, and claims process – is provided by the manufacturer, not by us. We are not responsible for injury, death, or property damage resulting from misuse of a product, failure to follow manufacturer instructions, or use of a product outside its intended purpose.
Section 15 – Not Medical Advice
Nothing on this site, and no information provided by our staff by phone, email, or in person, constitutes medical advice or a recommendation regarding your specific medical condition. We are a retailer of mobility and home medical equipment, not a licensed medical provider. Please consult your physician or another qualified healthcare professional to determine which product is appropriate for your needs before purchasing.
We ask that you not submit protected health information through this site beyond what is reasonably necessary to process, ship, and support your order (for example, delivery instructions related to accessibility).
Section 16 – Manufacturer Drop-Ship Fulfillment
Many of the products sold through this site ship directly from the manufacturer's warehouse or an authorized fulfillment partner, rather than from a Mobility Harbour facility. As a result, packaging, freight-carrier procedures, and certain delivery timelines are determined in part by the manufacturer and its shipping partners, and may vary by product. Please review our Shipping Policy for delivery expectations and instructions on inspecting your shipment and reporting damage.
Section 17 – Indemnification
You agree to indemnify, defend, and hold harmless Mobility Harbour, LLC and our officers, directors, employees, agents, and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.
Section 18 – Severability
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed, without affecting the validity of the remaining provisions.
Section 19 – Termination
These Terms of Service are effective unless and until terminated by either you or us. We may terminate this agreement at any time if, in our sole judgment, you fail to comply with any term or provision of these Terms, and may deny you access to the Service accordingly. Obligations incurred prior to termination shall survive termination.
Section 20 – Entire Agreement
These Terms of Service, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements or communications on the same subject.
Section 21 – Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Section 22 – Changes to These Terms of Service
You can review the most current version of these Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
